The website www.matrixgo.ai and systems, such as Chatbots & AI, Voice & Bots, Matrix ONE and MORPHEUS, which together will be referred to as “Matrix Platforms”, are owned, maintained and controlled by MATRIXGO ARTIFICIAL INTELLIGENCE AND SYSTEMS LTDA (“Matrix Go”), registered with the CNPJ under no. 29.061.574/0001-51, with headquarters at Avenida do Contorno, no. 2905, Room 408, Santa Efigênia Neighborhood, Municipality of Belo Horizonte, State of Minas Gerais, CEP-30.110-915.

MatrixGo is a company that aims to connect people and operates in the network engineering and telecommunications segment, working with advanced technical systems and with a team of experts ready to help.

This document aims to provide information on the collection, use, processing and storage of data provided by Users and is in compliance with Law 12,965/2014 (Marco Civil da Internet) and Law No. 13,709/18 (General Data Protection Law).

  • EXPLANATION OF TECHNICAL TERMS OR IN A FOREIGN LANGUAGE

Below are the meanings of technical nomenclatures and terms in the English language:

Cookies: Small text files stored on the user's computer and can be retrieved by the website that sent them during browsing. They are primarily used to identify and store information about visitors.

Cryptography: A set of principles and techniques for encrypting writing, making it unintelligible to those who do not have access to the agreed conventions.

In charge: Person appointed by the controller and operator to act as a communication channel between the controller, data subjects and the National Data Protection Authority (ANPD).

IP (or Internet Protocol): Unique identification for each computer connected to a network.



  USER PRIVACY AND THIRD-PARTY DATA OPERATORS

  1. Protecting your privacy is very important to us. Your personal data is transferred with RSA encryption and 256-bit SHA signature and stored on AWS servers, where access is restricted. We also use firewalls and HTTPS certificates, employing a variety of security technologies and procedures to help protect User information.
    1. These servers are independent and have no connection to this text. Therefore, we recommend that you also read the terms of use and privacy policies of these platforms and ensure you agree with all of their provisions before using our services.
    2. – The servers used by the Matrix Platforms are equipped with mechanisms capable of ensuring the security of your data, are located outside of Brazil, in the United States and are used so that MatrixGo can perform its service properly, in accordance with article 33, IX of Law No. 13709/18.
    3. – All access records, a set of information relating to the date and time of use of a given internet application from a given IP address, will be kept by MatrixGo, confidentially, in a controlled and secure environment, for a minimum period of 06 (six) months, in accordance with Law No. 12,965/2014, and article 7, II, of Law 13709/18.
    4. – The User must be responsible and declare himself exclusively responsible for all actions, as well as for all information and the veracity of the content that he inserts on the Matrix Platforms.



  DATA COLLECTION

  1. Data provided by the User: Name or Company Name, CPF or CNPJ, Cell Phone, WhatsApp, Email, and Business Address.
  2. Information we collect indirectly: We collect information indirectly through cookies, such as the IP address used, location and visit times.
  3. Contact history: MatrixGo stores information about all interactions between Users through the Matrix Platforms, such as online chat messages, emails, phone calls, and file uploads, as this improves our service and makes it more efficient. Without this history, every time you use the Matrix Platforms, you'd probably have to repeat what you've already told us.



PROCESSING OF PERSONAL DATA

  1. By accepting this privacy policy, the User understands that the collection and processing of the personal data below are necessary for the execution of the contract with Matrix Platforms, as per the information presented below.

Compliance with a legal or regulatory obligation by the controller (Art. 7, II, Law No. 13,709/2018).

Compliance with article 15 of Law No. 12,965/2014, which imposes the duty of Matrix Platforms to maintain their respective records of access to internet applications, confidentially, in a controlled and secure environment, for a period of 6 (six) months.

SHARING USER DATA

  1. Only people strictly necessary for the provision of the service, such as MatrixGo directors and marketing staff, may have internal access to User information. 
  2. MatrixGo will not share Users' confidential data with third parties, except by law or court order.
  3. MatrixGo will use the data for the purposes intended by the contractual instrument.



CANCELLATION OF MATRIX PLATFORMS, ACCESS ACCOUNTS AND DATA DELETION

  1. Cancellation of access accounts by MatrixGo: MatrixGo may, at its sole discretion, block, suspend, restrict, disable or prevent any User from accessing the Matrix Platforms whenever inappropriate conduct is detected and with margin of risk to the user MatrixGo.
  2. Cancellation of access accounts by the User: Users who wish to do so may directly request account cancellation (login) by sending an email to cancellation@matrixgo.ai.
  3. Data deletion: Upon cancellation of the account, when the purpose of data processing ends or upon request, the User will have all their data deleted/excluded immediately and permanently from the Matrix Platforms, except for data whose maintenance is mandatory by law or regulation, data necessary for the regular exercise of rights in judicial, administrative or arbitration proceedings, such as access logs (set of information regarding the date and time of use of a given internet application from a given IP address), which will be kept confidential, in a controlled and secure environment, for a period of 6 (six) months, under the terms of Law No. 12,965/2014 and with the legal basis of art. 7, II, of the General Personal Data Protection Law.



  RIGHTS OF THE PERSONAL DATA SUBJECT

  1. The holder of personal data has the right to obtain from MatrixGo, in relation to the data processed by it, at any time and upon request:
    1. – Confirmation of the existence of data processing;
    2. – Access to data;
    3. – Correction of incomplete, inaccurate or outdated data;
    4. – Anonymization, blocking or deletion of unnecessary, excessive data or data processed in non-compliance with the provisions of Law 13,709/2018;
    5. – Portability of data to another service or product provider, upon express request, in accordance with the regulations of the national authority, observing commercial and industrial secrets;
    6. – Deletion of data processed with the consent of the holder, except in the cases provided for in Law 13,709/2018;
    7. – Information from public and private entities with which MatrixGo shared data;
    8. – Information on the possibility of not providing consent and the consequences of refusal;
    9. – Revocation of consent.




SECURITY

  1. MatrixGo is committed to preserving the stability, security, and functionality of the Matrix Platforms through technical measures compatible with international standards and by encouraging the use of best practices. However, no service available on the internet offers a complete guarantee against illegal intrusions. In cases where unauthorized third parties illegally invade the systems, MatrixGo will do its best to find the person responsible for the illegal activity, but is not responsible for any damages caused. 
  1. MatrixGo will notify the national authority and the holder of any security incident that may result in significant risk or damage.  



  CHANGES TO PRIVACY POLICY

  1. MatrixGo may unilaterally add and/or modify any clause contained in these Privacy Policies. The updated version will apply to the use of the Matrix Platforms from the date of its publication. Continued access or use of the Matrix Platforms after publication will confirm the validity of the new Privacy Policies by Users.
  2. If the change made requires the User's consent, the option to freely, unequivocally and informedly accept the new text or reject it will be presented.
  3. If the User does not agree with the change, they may refuse to provide consent for specific acts or may terminate their relationship with MatrixGo entirely. This termination will not, however, exempt the User from complying with all obligations assumed under the previous versions of the Privacy Policies.



  MANAGER AND GENERAL PROVISIONS

  1. MatrixGo indicates Mr. Marco Túlio Testi Duarte as the person in charge, with email address lgpd@matrixgo.ai, under the terms of art. 41 of the General Data Protection Law, to accept complaints and communications from data subjects and the National Data Protection Authority, provide clarifications and take action.
  2. Matrix Platforms have specific text regulating the license of use, rights, duties, guarantees, and general provisions: the Terms of Use. All of these documents are an integral part of these Privacy Policies.

  1. MatrixGo provides the following channel to receive all communications that Users wish to make: by telephone and WhatsApp 0800 604 5555.
  2. Matrix Platforms have specific text regulating the license of use, rights, duties, guarantees, and general provisions: the Terms of Use. All of these documents are an integral part of these Privacy Policies.

COOKIE POLICY AND AUTOMATIC DATA COLLECTION TOOLS

In addition to being concerned about preserving your privacy, MatrixGo values the transparency of its activities, always seeking to make it clear to you, the user, how the Platform operates.

Therefore, by accepting MatrixGo's Terms of Use and Privacy Policy, you must be aware of and agree to our Cookies and Automatic Data Collection Tools Policy, which aims to clarify how such tools work, their purpose, and how to activate and deactivate them.

Therefore, we strongly recommend that you carefully read the Cookie Policy and Automatic Data Collection Tools before registering or even browsing the MatrixGo websites and platform.

 

Finally, we emphasize that although it is the User's option to allow or not the use of Cookies and other data collection tools, the User's refusal to use Cookies and automatic data collection tools will make it impossible for MatrixGo to provide services in a full and appropriate manner.



WHAT ARE COOKIES AND DATA COLLECTION TOOLS?

Before delving into the merits of why and for what we use Cookies and other similar technologies, we think it's important to clarify what these tools are.

In short, Cookies are a small data file (usually encrypted text files) that websites ask users' browsers to store, whether on their computers or mobile devices (cell phones, tablets, etc.).

Furthermore, the processing and use of information and data collected from Users must always comply with the platform's Privacy Policy, therefore, it is essential that the User carefully reads all platform policies.

It is worth remembering that, although most browsers accept Cookies, Users can always configure their browser to deny the application of Cookies, allowing them to be deleted whenever they want.



WHAT TYPE OF COOKIES DO WE USE?

Basically, there are two groups of Cookies that can be used:

PERMANENT COOKIES: These are cookies stored in the browser on your devices (PC, mobile, and tablet) and are used whenever you revisit one of our websites. They are generally used to direct browsing to the user's interests, allowing us to provide a more personalized service.

PREFERENCES: This cookie category allows the MATRIX platform to remember information that changes how the website behaves or is displayed, such as the user's preferred language or region. The main purpose of this type of cookie is to improve the user experience when using the platform.

 

SECURITY: Cookie category used to verify the user's identity, seeking to prevent fraudulent use of login credentials and protect user data from unauthorized third parties.

 

ANALYTICAL: This cookie category allows website and application owners to understand and analyze how visitors use and interact with their websites, products, and services by collecting information and usage statistics for website reports. This does not require personally identifying users.

TRACKING: Cookie category that, by storing files on the devices of visitors to our users' websites, records clicks on links, advertisements and commercial transactions, such as sales and leads.

It should be noted that the sole purpose of tracking cookies applied by the platform is to identify a transaction made by an affiliate through their affiliate link, thus allowing you to earn commissions for the completed transaction. Therefore, these cookies do not collect personally identifiable information from visitors, but only when and on which device a click on a given affiliate link occurred, and this information is recorded.

 

In this regard, it is emphasized that it is the obligation of MATRIX platform producers and affiliates, when generating and using the affiliate link containing tracking Cookies, to obtain the free, express, and unquestionable consent of their users and visitors to the websites and other environments where the affiliate links are shared and/or made available. Furthermore, Users (producers and affiliates) are fully responsible for complying with applicable laws and regulations regarding the protection of personal data, in particular the European Union's General Data Protection Regulation (GDPR), assuming the obligation to obtain the express and unequivocal consent of their users/customers regarding the collection, storage, processing, and processing of personal data, in accordance with applicable legislation. Therefore, MatrixGo will not be held liable for any failure by its Users to comply with such rules, reserving the right to suspend and/or cancel the contract with Users who are not in compliance with the applicable data protection legislation, as well as retain the balance of amounts receivable from such Users as partial compensation for damages experienced, or delivered to injured third parties, by court order.

ADVERTISING: Cookie category used to adapt advertising to the profile of the impacted User, improving their experience and seeking to provide greater effectiveness for advertisers.
